1. About Us

ButterflyAPI ("we", "us", "our") operates an AI-powered API and consumer creative tools platform at butterflyapi.com (the "Service"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

2. The Service

ButterflyAPI provides access to AI-powered tools including, but not limited to:

• Text-to-image generation
• Image-to-image transformation
• Background removal
• Image upscaling and enhancement
• Face restoration
• Photo-to-cartoon and art style conversion
• Watermarking
• Image captioning
• HTML-to-PDF conversion
• AI video generation and editing (Video Studio)

These tools are available via a consumer dashboard and a developer API. Access is subject to your chosen plan and available credit balance.

3. Eligibility

You must be at least 18 years old to use this Service. By creating an account, you confirm that you are 18 or older and that all information you provide is accurate and complete.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under your account. You must notify us immediately at support@butterflyapi.com if you suspect any unauthorised access. We reserve the right to terminate accounts that violate these Terms.

5. Credits and Billing

Access to AI tools requires credits, which are deducted per API call at rates shown on our pricing page. Credits can be purchased as one-off top-ups or included in a subscription plan.

• Credits are non-refundable except where required by applicable law.
• Pay-as-you-go (top-up) credits do not expire for active accounts.
• Subscription credits are renewed each billing cycle and do not roll over.
• Credits are forfeited if your account is terminated for breach of these Terms.

All prices are displayed in GBP. Payment is processed securely by Stripe, Inc. We reserve the right to change pricing with at least 14 days' notice to existing subscribers.

6. Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, defamatory, or sexually explicit content
• Produce non-consensual intimate imagery or deepfakes of real individuals without their consent
• Generate any content that sexualises or endangers minors
• Infringe any third-party intellectual property, privacy, or data protection rights
• Attempt to reverse-engineer, scrape, or circumvent any security measures
• Resell or redistribute access to the Service without our prior written consent
• Use the Service in any way that violates applicable laws or regulations

We reserve the right to suspend or terminate accounts and remove content that violates these provisions, without notice or refund.

7. Intellectual Property

You retain ownership of any content you upload. By uploading content, you grant us a limited, non-exclusive, royalty-free licence to process it solely to provide the Service to you.

Subject to these Terms and applicable law, you own the AI-generated outputs from your inputs. You are responsible for ensuring your use of those outputs complies with applicable law and does not infringe any third-party rights.

All trademarks, logos, and branding associated with ButterflyAPI remain our exclusive property.

8. Marketing Communications

If you opted in to marketing communications at registration, we may send you product updates, offers, and news by email. You can unsubscribe at any time by clicking the unsubscribe link in any marketing email or by contacting support@butterflyapi.com. Opting out will not affect transactional emails related to your account.

9. Third-Party Services

The Service uses third-party providers including Stripe (payments), fal.ai (AI model inference), Supabase (data storage and authentication), and Cloudflare (security). Your use of the Service is also subject to those providers' terms. We are not responsible for third-party outages or their handling of data.

10. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free, or that AI outputs will be accurate or meet your requirements. AI-generated content should be reviewed before use.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, revenue, or business opportunity. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited.

12. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your account if you breach these Terms or misuse the Service. Upon termination, your right to use the Service ends immediately. Unused subscription credits are forfeited on termination. Top-up credits are forfeited if termination is due to a breach of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice within the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
